The WSJ reports today on a novel way to defend yourself against DUI 
accusations. The argument goes like this. Breath analyzers use software 
to determine the blood alcohol level. Software is notoriously faulty. 
Without complete access to the software source code, it is impossible 
to determine whether the result is correct. The measurement for this 
case may have been a fluke.

Four courts in FL have bought into this argument, because the maker has 
refused to publish the software.

Will they adapt this argument to DUI/cell phone? After all the use of a 
cell phone is equivalent to two high alcohol drinks :-)
